HAVEN REAL ESTATE and FAIR HOUSING

Haven Real Estate and its agents continually strive to act in accordance with the Fair Housing Act, which prohibits "any preference, limitation, or discrimination because of race, color, religion, sex, handicap or disability, familial status, or national origin, or intention to make such preference, limitation or discrimination".
In California, Fair Housing laws protect tenants from discrimination in housing based on several factors, including race, color, national origin, religion, sex, familial status, and disability. Additionally, California law prohibits discrimination based on other factors like age, source of income, marital status, and more. Landlords must provide reasonable accommodations for disabilities and cannot discriminate against individuals with disabilities or service animals.
Key Fair Housing Protections in California:
-
Discrimination:
It's illegal to refuse housing or treat individuals differently based on protected characteristics like race, religion, or disability.
-
Reasonable Accommodations:
Landlords must make reasonable accommodations for individuals with disabilities to ensure they can use and enjoy the property, including modifications to the property or changes in rules and policies.
-
Occupancy Limits:
Occupancy standards cannot be overly restrictive and must be reasonable based on the size and layout of the apartment.
-
Service Animals:
Landlords generally cannot discriminate against tenants who have service animals or emotional support animals, even if the property has a "no pets" policy.
-
Familial Status:
Landlords cannot discriminate against families with children.
-
Source of Income:
Discrimination based on a tenant's source of income is illegal, according to Fair Housing Advocates of Northern California.
-
Harassment:
Landlords cannot harass or threaten tenants based on protected characteristics.
-
Rent Increases:
Landlords are limited in how much they can increase rent, with the California Tenant Protection Act of 2019 limiting increases to a certain percentage or a certain amount based on the Consumer Price Index (CPI).
-
Evictions:
Landlords need just cause to evict a tenant, and they cannot evict without proper legal procedures.
